1. About this Policy
Timeless Events Group Pty Ltd (ABN 73 683 209 627), trading as Timeless Touring (we, us, our), is a live entertainment promoter and event producer. We respect your privacy and are committed to handling personal information in accordance with the Privacy Act 1988 (Cth) (Privacy Act), the Australian Privacy Principles (APPs), the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth).
This Policy explains what personal information we collect, how we collect and hold it, why we use it, who we disclose it to, and how you can access, correct or complain about our handling of it.
This Policy applies to personal information we collect through any channel, including our websites, social media pages, telephone hotlines, email, in-person interactions, and personal information collected on our behalf, or provided to us, by ticketing agents, venues, box offices, co-promoters, event partners and other authorised third parties.
2. Scope
This Policy applies to all personal information we hold about:
- purchasers and holders of tickets to events we promote, produce, present or co-present;
- attendees at our events, including guests, accredited media and industry attendees;
- subscribers to our mailing lists, hotlines and alert services;
- visitors to our websites and users of our social media pages and digital advertising;
- contractors, suppliers, artists, artist representatives, venue personnel and touring party members; and
- investors, prospective investors and business counterparties.
This Policy does not apply to the separate privacy practices of ticketing agents, venues or other third parties, who each operate under their own privacy policies. We are not responsible for the privacy practices of any third party, including any website linked from our digital properties.
3. What personal information we collect
Depending on your dealings with us, we may collect:
Identity and contact information — name, postal address, email address, telephone and mobile numbers, date of birth or age bracket, and preferred language.
Transaction and ticketing information — ticket type, quantity, seat or reserve allocation, price paid, transaction reference, purchase channel, on-sale window, booking history, resale and refund history, and (in a masked or tokenised form only) payment card details. We do not store full payment card numbers; payments are processed by our ticketing agents and payment providers.
Event participation information — attendance and scan data, access requirements, accessibility requests, VIP or meet-and-greet participation, guest list and accreditation details.
Marketing and engagement information — your marketing preferences and consents, which of our messages you open or click, competition and survey entries, hotline enquiries, and your interactions with our social media and advertising.
Digital and device information — IP address, device and browser type, operating system, referring URL, pages viewed, session duration, approximate location derived from IP address, and identifiers set by cookies, pixels and similar technologies.
Audio-visual material — photographs, film and audio recordings captured at our events (see section 9), and CCTV footage where operated by us or a venue.
Business counterparty information — for suppliers, contractors, artists and investors, we may also collect ABN, company details, banking details for payment, insurance details, visa and travel documentation, and qualification or accreditation records.
Sensitive information. We generally do not seek sensitive information. Where accessibility, dietary, medical or similar information is necessary (for example, to provide accessible seating or manage a health and safety requirement), we will collect it only with your consent and use it only for the purpose for which it was provided and directly related purposes.
4. How we collect personal information
Directly from you — when you contact us, subscribe to our lists, enter a competition, call our hotlines, apply for accreditation, or engage with us commercially.
From our ticketing agents — including Ticketek, Ticketmaster, AXS, Moshtix and any other agent appointed for an event. Where you purchase a ticket to an event we promote, the ticketing agent collects your personal information both for its own purposes and, as our agent, on our behalf. That information is disclosed to us as promoter of the event in accordance with the collection notice presented to you at the point of purchase and the terms of our agreement with that agent.
From venues and box offices — including in respect of tickets sold through venue box offices or venue membership channels.
From co-promoters and event partners — where an event is presented jointly, each promoter may collect and hold attendee information for that event.
From third parties generally — artist management, publicists, advertising and analytics platforms, social media platforms, fraud prevention and identity services, and publicly available sources.
If we collect your personal information from someone other than you, we will take reasonable steps to ensure you are made aware of that collection, unless an exception under the APPs applies.
5. Why we collect, hold, use and disclose personal information
We collect, hold, use and disclose personal information for the following purposes and for any purpose reasonably related to them, being purposes you would reasonably expect:
- Selling, issuing, fulfilling, transferring, refunding and cancelling tickets, and administering resale and exchange.
- Producing, staging, managing and securing our events, including access control, crowd management and health and safety.
- Communicating with you about an event you have booked, including on-sale confirmations, venue and set-time information, transport and access information, and changes, postponements, reschedules or cancellations.
- Verifying identity, preventing and investigating fraud, scalping, chargebacks, unauthorised resale and breaches of ticket terms and conditions.
- Direct marketing of our events, tours, presales, ticket releases, hospitality packages, merchandise and offers, and those of our co-promoters, artists, venues and partners (see section 7).
- Building, segmenting, analysing and enriching our customer database, including analysis of purchase behaviour, genre and artist affinity, geography and lifetime value.
- Creating and using audience segments on advertising platforms, including matched, custom and lookalike audiences, for the promotion of our events.
- Market research, audience measurement, demand forecasting, pricing analysis, venue and market selection, and reporting to artists, agents, investors and co-promoters (in aggregate or de-identified form unless disclosure of personal information is required under the relevant agreement).
- Managing our commercial relationships with artists, agents, venues, suppliers, insurers, funders and investors.
- Managing complaints, disputes, incidents, insurance claims and legal proceedings.
- Complying with our legal obligations, including under work health and safety, liquor, taxation and record-keeping laws, and responding to lawful requests from courts, regulators and law enforcement.
- Any other purpose disclosed to you at or before the time of collection, or to which you consent.
6. Who we disclose personal information to
We may disclose your personal information to:
- our related bodies corporate, and our directors, employees and contractors on a need-to-know basis;
- co-promoters and joint venture partners for events we present jointly, who may use that information for their own event-related and marketing purposes in accordance with their own privacy policies;
- artists, artist management, agents and record labels performing at or associated with an event, generally in aggregate or de-identified form, and in identified form only where required under the relevant engagement agreement;
- venues and venue operators, for access control, security, health and safety, and venue-related communications;
- ticketing agents and box offices, for ticketing, fulfilment, refunds and customer service;
- service providers — including IT, cloud hosting, email and SMS platforms, CRM, data analytics, printing and mailing houses, security and crowd management contractors, payment processors, market research firms and professional advisers;
- advertising and social media platforms — including for the creation of matched and lookalike audiences, in each case in hashed or otherwise protected form where the platform supports it;
- insurers, insurance brokers, loss adjusters and legal advisers, in connection with a claim, incident or dispute;
- regulators, courts, law enforcement and government agencies, where required or authorised by law;
- an actual or proposed purchaser, investor, funder or successor in connection with a sale, restructure, financing or transfer of all or part of our business or assets, subject to appropriate confidentiality arrangements; and
- any other person with your consent, or where required or authorised by law.
7. Direct marketing and your choices
We use personal information to send you marketing communications about our events and the events of our partners, by email, SMS, telephone, post and targeted digital advertising.
Where you have purchased a ticket to one of our events, subscribed to one of our lists or hotlines, or otherwise entered into a commercial relationship with us, we treat that relationship as giving rise to consent (whether express or inferred) to receive marketing communications from us about events, tours and offers of a similar kind, consistent with the Spam Act 2003 (Cth).
Every electronic marketing message we send will clearly identify us as the sender and will contain a functional, low-friction unsubscribe facility. We will action any unsubscribe request within 5 business days and will not send you further marketing messages once you have opted out. You may also opt out at any time by contacting us using the details in section 15.
Opting out of marketing will not stop us sending you operational or transactional messages about a ticket you hold — for example, notice of a set time change, venue change, postponement or cancellation.
If you ask us to, we will tell you where we obtained your information from, where it is reasonable and practicable to do so.
8. Cookies, pixels and online tracking
Our websites and digital advertising use cookies, tracking pixels, SDKs and similar technologies (including those operated by Meta, Google and TikTok) to enable site functionality, measure campaign performance, understand audience behaviour and deliver targeted advertising.
Most browsers allow you to refuse or delete cookies. Disabling cookies may affect the functionality of our websites. You can manage advertising preferences through the settings offered by the relevant platform.
9. Photography, filming and recording at events
Our events are photographed, filmed and recorded. By entering an event we promote, you acknowledge and agree that you may be photographed, filmed or recorded, and that such material may be used by us, our co-promoters, the artist and their representatives, the venue and our media partners for promotional, archival, editorial, broadcast and commercial purposes, in any media now known or later developed, worldwide, in perpetuity and without further notice, compensation or approval.
If you do not wish to appear in such material, please contact the event's front-of-house or security team on site, or contact us using the details in section 15, and we will take reasonable steps to accommodate your request.
10. Storage and security
We hold personal information in electronic form on systems operated by us and by our service providers, and in limited cases in hard copy. We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure, including access controls, staff confidentiality obligations, contractual protections with service providers and secure hosting.
No method of transmission or storage is completely secure. While we take reasonable steps to protect your personal information, we do not warrant, and cannot guarantee, the security of information transmitted to us or held on our behalf, and to the maximum extent permitted by law we exclude liability for any unauthorised access to or disclosure of that information other than to the extent caused by our failure to take the reasonable steps required by the Privacy Act.
11. Data retention
We retain personal information for as long as it is needed for the purposes described in this Policy, including for the ongoing management of our customer relationship with you and our direct marketing activities, and for as long as required by law (including a minimum of seven years for financial and taxation records). We will destroy or de-identify personal information when it is no longer needed for any purpose for which it may be used or disclosed and we are not legally required to retain it.
12. Data breaches
We maintain a data breach response plan. If we suffer an eligible data breach under the Notifiable Data Breaches scheme in Part IIIC of the Privacy Act, we will assess the breach and, where required, notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as soon as practicable.
13. Access and correction
You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Requests should be made using the details in section 15.
We will respond to your request within a reasonable period (and in any event within 30 days) and will require you to verify your identity before we release any information.
We may refuse access or correction where permitted under the Privacy Act, including where giving access would have an unreasonable impact on the privacy of others, would reveal commercially sensitive or confidential information (including our commercial evaluative and pricing information), would be unlawful, or where the request is frivolous or vexatious. Where we refuse, we will give you written reasons and information about how to complain. We may charge a reasonable fee to cover the cost of locating, retrieving and supplying the information requested, but we will not charge you for making the request or for correcting information.
14. Complaints
If you have a concern about how we have handled your personal information, please contact our Privacy Officer using the details in section 15. Please set out your complaint in writing with enough detail for us to investigate.
We ask that you allow us 30 days to investigate and respond before escalating your complaint. We will acknowledge your complaint within 5 business days and respond substantively within 30 days.

We may update this Policy from time to time. The current version will always be available at www.timelesstouring.com.au and takes effect from the date it is posted. Where changes are material, we will take reasonable steps to notify you. Your continued dealings with us after a change takes effect indicate your acceptance of the updated Policy.
